Support HUD’s Proposed Rule Changes for Fair Housing Opportunities!
The U.S. Department of Housing and Urban Development (HUD) recently proposed new rule changes that could have a significant impact on individuals with criminal records who are seeking housing assistance through HUD Public and Indian Housing Programs. These proposed rule changes would revise existing regulations governing admission for applicants with criminal histories, requiring Public Housing Agencies (PHAs) and assisted Housing owners to consider multiple factors, including the recency and relevance of prior criminal activity, before making any discretionary denials or terminations.
Under the proposed rules, PHAs and assisted Housing owners would be required to conduct an individualized assessment for each applicant with a criminal record, taking into consideration the nature of the offense, the time that has passed since the offense occurred, and the individual's actions since the offense. This new approach aims to provide a more fair and equitable process for individuals with criminal records who are seeking housing assistance, allowing for a more holistic assessment of each applicant's circumstances.
Nation Outside supports these proposed rule changes as a positive step towards more equitable housing policies. By considering multiple factors and conducting individual assessments, the proposed rules would give individuals with criminal records a better chance at accessing safe and stable housing, ultimately reducing barriers to reentry and promoting rehabilitation.

By sharing their perspectives and experiences, stakeholders can help shape these important revisions to HUD's regulations and advocate for more inclusive housing policies for individuals with criminal records.

Lansing City Council Endorses HB 4878
On Monday, April 9 the Lansing City Council took the historic step of passing a Resolution in favor of HB 4878, The Michigan Fair Chance Housing Act. In doing so, Lansing adds its name to the ever-growing list of cities that recognize housing as a right and further, that a past legal conviction should not mean a life sentence of housing insecurity.
The endorsement of HB 4878 by the Lansing City Council is a significant and necessary step towards moving The Michigan Fair Chance Housing Act in another Lansing building - The State Legislature - and making this common-sense policy the law of the land. Nation Outside stands in solidarity with the people of Lansing and celebrates this bold affirmation of housing as a fundamental right in Michigan.
“More and more people and communities are coming to understand the real benefits of Fair Chance Housing and the critical role of HB 4878,” said Tony Gant, Nation Outside Co-Executive Director. “This vote is the culmination of many years of educating the public and coalition building including our Housing Not Hurdles campaign, but there remains much work yet to be done. We believe that EVERYONE DESERVES A HOME. Housing is a human right for all of us, not just for some. But for nearly 1 in 3 Michiganders with a criminal record, access to safe and affordable housing remains out of reach.
Fair Chance Housing
Systemic discrimination against people with criminal records in tenant screening is a persistent barrier to housing access, economic stability, and public safety, and contributes to the prison-to-homelessness pipeline. On June 26, 2023 the Michigan Fair Chance Access to Housing Act (HB 4878) was introduced by Representative Abraham Aiyash and 20+ co-sponsors in an effort to expand affordable housing and combat homelessness.

Under existing law, housing providers and landlords have significant discretion with respect to tenant screening, leading to overly restrictive policies that unfairly screen out good tenants and neighbors. People with criminal records are openly discriminated against, being denied the opportunity to reunify with family post-incarceration and putting them at risk of housing instability, homelessness, and recidivism. The Fair Chance at Housing Act will reduce the impact of the collateral consequences associated with having a criminal record by expanding opportunities for all Michiganders to secure stable, accessible and affordable housing.

The Michigan Fair Chance Access to Housing Act provides critical protections against housing discrimination based on prior criminal history by regulating the use of criminal background checks. During the tenant screening process, housing providers would be required to perform an individualized review of each applicant that considers the totality of the circumstances, rather than automatically disqualifying them due to their past mistakes.

Housing insecurity and homelessness present pervasive problems impacting the more than 8,000 people who come home from prison each year across the state of Michigan.

The staggering 2 million to 3 million people living in Michigan with criminal convictions underscores the challenges they face in finding safe and stable housing.
These challenges create significant obstacles for successful reintegration into society and increase the risk of recidivism.
We are dedicated to the belief in the power of second chances and firmly believe that strengthening access to housing for people with criminal records is key to successful reentry.
